Unenforceability, Unenforceable

In U.S. patent law the lesser sanction for inequitable conduct or patent misuse is to render the patent unenforceable (essentially useless) and can be applied by the courts directly; the higher penalty and that applied in most systems is outright cancellation of the patent.
