Constructive Dismissal

Where the terms or conditions of an employee’s position are unilaterally varied by the employer, by for example lowering pay or substantially reducing benefits or by a demotion or effective demotion (e.g., the reduction of responsibilities), this action can in many common law countries (except most of the United States) be considered tantamount to firing the employee and may give the employee the right to claim damages.
