Cross border injunction

An injunction issued by one European court which is applicable in another European country under the Brussels Convention. Until 2006 some European courts issued cross-border injunctions in cases of patent infringement; however this practice ended when the European Court of Justice issued a ruling that patent infringement had to adjudged on a country-by-country, member state basis. Cross-border injunctions remain available in the context of Design Rights and European Trademarks.
