Secondary Meaning

A word, which is not fanciful or is even descriptive, can be trademarked if it can be shown that it has come to have a secondary meaning in the eyes of the public, which as a result associates it exclusively with the applicant’s goods or services, allowing its registration as a trademark, or potentially treatment as an unregistered trademark. The term ‘acquired distinctiveness’ is also used for this purpose.
