Remittitur

The reduction of a jury’s award of damages by a judge without otherwise reversing the jury’s liability finding. Remittitur arises usually in the trial court, but sometimes on appeal, where the judge or appeal court concludes that the jury award was excessive in terms of the general amount, or because there was an error in the damages calculation reported by the jury, for example some sort of Double Recovery or Double Counting
