Exemplary Damages

A term for punitive damages. Exemplary damages exceed actual damages and are intended to make an example of the defendant, as a warning to others. Enhanced Damages are a form of Exemplary Damages that are in some respects intended to serve the same purpose but are normally provided as part of a statutory scheme. While some legal systems will award exemplary damages, many legal systems have a strong policy bias against them, especially in contract law.
