The United States Department of Justice Antitrust Division has a procedure whereby a business concerned about whether a proposed business arrangement is legal under the Antitrust laws, can submit the arrangement to the DoJ for a business review at the end of which the DoJ will issue a letter reviewing the legality of the arrangement and any changes it sees as necessary to ensure legality. It is very akin to the European Commission’s Comfort Letter.
