The European Commercial Agents Directive caused EU member states to encorporate certain protections into their national laws governing the relationships between principals and commercial agents appointed in EU member states. A key feature is the requirement that the principal may have to compensate the agent for the loss of the agency. For this reason the retention and termination of commercial agents (and distributors) in EU countries should be approached with care.
