An agreement where the terms are available to a party via a hypertext link. Care needs to be taken when designing hyper wrap agreements, to ensure that the link to contractual terms is prominent and that some for of record keeping is possible, if and when the terms of the offered agreement changes, so that the version that a party agreed to can be readily identified. Hyper wrap agreement raise some of the same concerns as shrink-wrap, click wrap and browse wrap licenses.
